There are more product liability lawsuits filed against prescription drug manufacturers than against all other industries combined. Under strict product liability laws, drug manufacturers may be held liable for ANY serious injuries or deaths caused by their products regardless of the care they took to prevent defects.

Hazardous waste presents serious problems not only to humans but to the environment as well. Environmental law matters are particularly complex, not only due to the maze of federal, state and local laws involved but also because these laws are often highly technical in nature.

Toyota Recalls

Toyota recall attorney

Toyota is the largest car maker in the world and the company is currently facing a host of lawsuits.

In 2009 people began filing class-action suits against the company as a result of several makes and models of Toyotas that have a fatal sudden acceleration malfunction. Other cases have involved Toyota's gas pedals sticking and floor mats that were pushing down on gas pedals.
Fatal accidents due to other problems have also increased in number since 2002 when Toyota began installing an electronic throttle-control system in their cars (the ETCS-Intelligent System). This system may malfunction, resulting in the vehicle accelerating at random times when the driver is not pressing on the gas pedal. In many of these cases drivers are unable to get their cars to stop or slow down and it has resulted in a host of fatalities.

Because of the multiple legal issues involving vehicles produced by Toyota Motor Corp., we have developed a separate website to deal specifically with these cases.

In 2010 Toyota Motor Corp. admitted that accelerator pedal defects affected several million Toyota, Scion, and Lexus cars and trucks, covering model years 2005 through 2010.
Prius drivers in the U.S. and Japan have also complained about a brief delay prior to the brakes engaging, which Toyota insists can be corrected with a change in software programming. Despite the admission by Toyota president Akio Toyoda that the company may have mishandled the problem of gas pedals becoming stuck, a recall on the Toyota Prius for braking problems has not been issued.
In late 2012, Toyota agreed to settle a class-action lawsuit for $1.1 billion. Monetary compensation and safety upgrades are available to roughly 16 million owners of Toyota, Scion, and Lexus vehicles, based on the age of the model and age of vehicle.

In February 2013 Toyota agreed to pay $29 million and vowed to make vehicle information more accessible in a deal with attorneys general in 29 states about the way it conducted its recalls.

Holding Companies Liable:

Companies that manufacture or sell products to the public are legally responsible to ensure that they are safe. If their products cause injuries or illnesses to consumers, victims have legal recourse to obtain compensation for their damages by filing claims under the product liability law. This includes claims against pharmaceutical companies for dangerous drugs, drug recalls, and pharmaceutical injuries.

Air bags save thousands of lives every year, and are essential safety devices for drivers and passengers. Unfortunately, defective air bags can have the opposite effect and actually create serious safety hazards. Millions of vehicles have now been recalled by Honda, Toyota, and other major auto-makers because air bags exploded, failed to deploy, opened without warning, or had other problems that can cause severe injury or even death.

The US Government applies certain regulations on manufacturers to insure against defective products; but those regulations often go unenforced, and may lack the sufficient penalties to curb abuse.

As consumers, we trust that the products we purchase meet certain standards for safety. We also have to trust that the products used or prescribed by our physicians and those made available to us through the various businesses we use are safe and free defects or flaws that could inflict injury, illness, or death.
In most cases this trust is well founded, but unfortunately defective and dangerous products still do find their way into our homes, hospitals, offices and businesses.

Our government has specific agencies such as the Food and Drug Administration (FDA), the National Highway Traffic and Safety Administration (NHTSA) and the Consumer Product Safety Commission (CPSC) which are intended to monitor product safety, yet faulty products do occasionally reach the consumer market, placing the lives of the public in harm's way. Product manufacturer negligence can be associated with inefficient testing, contamination, the failure to maintain a premises, poor manufacturing, computer errors or human oversight. Product recalls and drug recalls help alert consumers to the potential risks of defective products that they may already own, but these announcements come too late for anybody who has already suffered injury or the family members of those who have been killed.

If you have sustained injuries or substantial property damage because of a product defect or recalled drug, you may have a product liability claim.

Product liability relates to any harm to consumers stemming from marketing misrepresentation, manufacturing defects, poor design, labeling errors, or the failure to warn of specific side effects or additional risks.
An experienced product liability attorney helps individuals in the prosecution of reckless or negligent manufacturers who distribute defective or mislabeled products. Product liability lawsuits are often the consumer's most effective weapon against unreasonably dangerous products.
